These terms apply to the enjoypicnic.com website and to every purchase made through it. “Picnic”, “we” and “us” mean the operator of this store. By using the site or placing an order you agree to these terms. If you don’t agree, please don’t use the site.
1. You must be 21 or older
Picnic products contain nicotine and are sold only to adults 21 years of age or older. By using this site or placing an order you confirm that you are at least 21. We may use age-verification tools and may ask for a copy of government-issued ID before shipping. We will cancel and refund any order we cannot verify, and we may refuse future orders from anyone who provides false age information.
2. About the product
Picnic makes nicotine-infused toothpicks for adults who already use nicotine. Picnic is not a smoking-cessation product and is not intended to help you quit smoking or to treat, prevent or cure any condition. Use only as directed on the package. Keep out of reach of children and pets, and dispose of used picks where children and pets can’t reach them.
3. Products, prices and availability
We try to describe our products and prices accurately, but errors happen. We may correct errors, change prices, limit quantities and discontinue products at any time without notice, including after you place an order; if we can’t supply an item you ordered, we’ll tell you and refund what you paid for it. Product images are for illustration; packaging may vary.
4. Orders and payment
Your order is an offer to buy, which we accept when we ship it. We may refuse or cancel any order, for example where we suspect fraud or unauthorized resale, can’t ship to the address given, or cannot verify that the buyer is 21 or older. Payment is collected through Shopify’s secure checkout; we don’t store your full card details. You agree to provide current, complete and accurate billing and shipping information. Sales tax is charged where required by law.
5. Shipping
We ship to addresses in the United States only. Some states, cities and localities restrict the sale or shipment of nicotine products; it is your responsibility to know the rules where you live, and we may cancel and refund orders to addresses we can’t ship to. Risk of loss passes to you when the carrier delivers to the address you gave us. Rates, timing and free-shipping thresholds are on our Shipping & Delivery page.
6. Returns and refunds
Our Refund Policy is part of these terms. In short: opened tubes can’t be returned, and damaged, wrong or missing items are replaced or refunded if you tell us within 14 days of delivery.
7. Discount codes and promotions
Discount codes have no cash value, can’t be combined unless we say so, and may be changed or withdrawn at any time. We may cancel orders that misuse a code.
8. Wholesale
Stores and distributors must hold any tobacco or nicotine retail license their state or city requires and must check ID for anyone who looks under 30. Wholesale orders are governed by the separate terms we agree with each retailer.
9. Reviews and other content you submit
If you post a review, comment or other content, you give us a non-exclusive, royalty-free, perpetual license to use, edit and display it in connection with our business. Don’t submit anything unlawful, false, infringing or offensive, and don’t make health or quit-smoking claims about our products. We may remove content at our discretion.
10. Our content
The Picnic name, logo, product designs, photos and text on this site belong to us or our licensors and are protected by trademark and copyright law. You may not copy or use them without our written permission, except to share a link to the site.
11. Acceptable use
You agree not to use the site for any unlawful purpose; buy products for anyone under 21; scrape, copy or interfere with the site or its security; impersonate anyone; or upload malicious code. We may suspend or end your access for any breach.
12. Third-party services
The site uses third-party services (for example payment, shipping, reviews and age verification) and may link to other sites. We don’t control them and aren’t responsible for their content or practices.
13. Disclaimer and limitation of liability
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, Picnic and its owners, employees and suppliers will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or products, and our total liability for any claim relating to an order is limited to the amount you paid for that order. Some states don’t allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Picnic and its owners, employees and suppliers from any claim or demand, including reasonable attorneys’ fees, arising from your breach of these terms or of any law, or from content you submit.
15. Governing law
These terms and any sale are governed by the laws of the State of New York, without regard to conflict-of-law rules, and any dispute will be brought in the state or federal courts located in New York.
16. Changes and the whole agreement
We may update these terms at any time by posting the new version on this page; continuing to use the site after a change means you accept it. If any part of these terms is found unenforceable, the rest remains in effect. These terms, our Refund Policy, Shipping & Delivery page and Privacy Policy are the entire agreement between you and us about the site and your purchases.
